By-Laws

Condominium By-Laws, The Act, and Alberta Condominium Regulations

​Your Board of Directors are mandated to govern, manage, maintain and operate Crossbow Point in the best interest of the condominium Corporation and the Unit Owners in compliance with the Condominium Property Act (Alberta), 01 January and the  Condominium Property Regulation (Alberta) of 01 January 2020 (click) and By-Laws specific to Crossbow Point, plus any rules established and advised by the Board.

A copy of the Condo By-Laws can be found by clicking this link: By-Laws. The Crossbow Point and Crossbow Landing By-Laws for the Condominium Corporation No. 031 0034 were filed and dated 03 Mar 2003 with the Alberta Land Titles Office. The By-laws establish the legal basis for the Crossbow Point Condo Board and the Crossbow Landing Condo Board. The purpose of the By-Laws is to provide for (i) the health, safety, peace, comfort and convenience of our occupants, as well as (ii) the maintenance of property values and (iii) the development of a sense of community.

The amended Condominium Property Act and regulations came into force on 01 January, 2020. Consequently all bylaws and rules have to meet the requirements of the new Act and the regulations. A new set of bylaws is at the development stage.

Rules, frequently called policies,  are focused on the procedures used in the administration of the corporation or administration of the real and personal property of the corporation, the common property and the managed property. The Crossbow Point Board has prepared the "Crossbow Point Rules" document. This includes all the rules and policies that were made or amended before January 1, 2020. They were published on March 23, 2020 and copies sent to all Unit Owners and tenants.

In compliance with the Alberta Condominium Act, and specifically as it pertains to the Standard Insurable Unit Description (SIUD) - as detailed in the Regulations that took effect January 1st 2020 - the Board drafted, approved and issued detailed standard interior specification. The detailed  documents are listed and linked in the next webpage.

To be amended: Among the key provisions, the By-laws (in part):
  • identifies a resident occupancy restriction on the Crossbow Point Buildings as being age 40  and above.
  • establishes the duties of an owner in relation to the property and to the Condo Corporation.
  • establishes the duties and powers of the Corporation in addition to those contained in the Condominium Act of Alberta to control, manage, maintain, repair and administer the Condo Common Property.
  • establishes the basis for the collection of contributions towards Common Expenses for the condo entity. This includes applying interest charges on any amounts owed in arrears by Unit Owners.
  • establishes authority for the Board to institute such rules and regulations as it may deem necessary in relation to the use, enjoyment and safety of the Common Property. This includes an enforcement provision.
  • provides Board with direction to establish and maintain a Reserve Fund for replacement and contingency expenses.
  • provides Board with authority to levy assessments and special assessments based on Unit Factors.
  • establishes the role, duties and operating parameters (including meetings and voting process) for the Condo Boards.
  • establishes insurance requirements for the Corporation.
  • establishes parameters for determination of assessments for common expenses and budgets
  • establishes provisions for owners who wish to lease their Condo Unit
  • sets out use and occupancy restrictions for Owners
  • sets out use of recreation areas
  • establishes easement parameters for each Unit and Common Property
  • establishes parking parameters.
